ICBC Injury Claims

Most BC motor vehicle accidents involve ICBC.  ICBC is the universal auto insurer in British Columbia.  Therefore, even though ICBC is most likely your insurer, they are also likely the other driver’s insurer as well.  Although you claim against the at-fault driver(s), you in practice, make a claim against ICBC.  ICBC is the entity that pays for your motor vehicle accident compensation.

Navigating and pursuing an ICBC claim involves some paperwork and experience, which ICBC lawyers can help you with from the start.  Moreover, ICBC will likely ask you to make a statement and sign some documents.  We recommend you talk to our ICBC injury claim lawyers first.

The fact is if you dispute ICBC’s finding of fault from a BC motor vehicle accident, you can (or we can if you hire our ICBC lawyers) work to obtain evidence that persuades ICBC you’re not at fault.  If ICBC continues to find you at fault, then you can present your case in Court and let the Court decide.

Bicycle and pedestrian accidents

Question: If I’m hurt as a cyclist or pedestrian by an ICBC insured motor vehicle, do I make an ICBC claim?

Yes you do as long as the driver of the motor vehicle is at-fault for the crash.  Just because you weren’t in a car or truck doesn’t mean you don’t pursue an ICBC claim.  Because the at-fault driver is insured by ICBC, you pursue your claim against the at-fault driver which brings in ICBC.

Hit and Run Accidents

Sometimes people who cause motor vehicle accidents leave the scene.  It’s bad enough being in an accident, it becomes more frustrating if the other driver leaves the scene.  Don’t worry if the other driver leaves the scene of your motor vehicle accident.  You can still make a claim.  BC law provides for making an ICBC injury claim against an unknown and unidentified driver.

ICBC may say you didn’t try hard enough to identify the other driver/motor vehicle

Sometimes ICBC may deny your claim saying you didn’t make a big enough effort to identify the other driver/motor vehicle.  Frankly, it’s difficult to gather your wits after a crash to memorize a licence plate and vehicle make/model (if you even know make and models of motor vehicles).
