Planning your personal injury claim

We start by meeting with you to discuss your claim.  The starting point once you hire us is to help you get treatment and plan your recovery process with your family doctor and other specialists.

As you get treatment, we communicate with your treatment providers and in many cases ask them to prepare written reports about your injuries.

Sometimes getting in to see a medical specialist can take a long time, so we like to proactively plan your medical case from the start, or as soon as escalated medical care becomes apparent.  We then schedule all necessary appointments, sometimes doing so privately in order to speed up the process for you.

Building your personal injury case

As you continue with medical care and as we communicate with all the experts and treatment providers involved with your claim, we gather all the documentation relevant to your claim, including your medical documentation.  We review it and then plan the next stage of your case, all the while building your claim being mindful that in time we may present your case in Court, or at the very least present it to ICBC for resolution.

Presenting your personal injury claim

The final stage of a personal injury claim is presenting your case.  We start by presenting your case to ICBC (or another insurer that’s involved), either directly or in a mediation.  If your case doesn’t resolve at this stage, then we set out to prepare final plans for presenting your case in trial.

Don’t worry if you’re not too keen about going to trial; most claims resolve before trial.  However, when you hire us, there is always a chance you may have no choice but to go to trial.  We keep you fully advised about what is happening along the way so you can make informed decisions.

We can’t and don’t make decisions for you.  Instead, we inform you about settlement offers, give you our recommendations, but the decisions along the way are yours.

If your injury occurred several months or even up to 2 years ago, we’re happy to meet with you; the initial consultation is free.  Even if you’ve started your own lawsuit, but then decide to hire a lawyer, we welcome you to meet with us to see about getting our personal injury team on your side.

Please note that with personal injury claims in BC there is a 2 year limitation date with some exceptions (such as a person under age 19).  Therefore, we STRONGLY advise that you discuss your personal injury matter with us well before 2 years from the date of your injury whenever possible.

Contingency Fee

The personal injury lawyers at Campbell Burton McMullan do personal injury cases on contingency.  This means that our legal fee is a percentage of the compensation you receive.   Moreover, we don’t get paid if and until you receive compensation.

Presently, we’re also offering a $250 discount off of our personal injury fees.  All you have to do is ask for the discount when you hire us or before, and upon your claim’s resolution, your legal fee will be reduced by $250.
